2024 Florida Legislative Session & Education-Related Bills

The FCSA’s primary issues during the 2024 Florida Legislative Session are to monitor per-student FTE allocation and advocate for continued support of Capital Outlay. These are the two critical items that drive your budget. Governor Desantis’s recommended budget included an estimated 2% increase in Student FTE and $220 Million in Capital Outlay. The Governor’s budget also recommended additional funds for teacher raises. The FCSA advocacy team,  led by Ralph Arza, will focus on legislative priorities and critical issues identified by our members. This session, we’ll work with policymakers to ensure the freedoms that charter schools have are protected and that no barriers are created to impede student success and the movement’s growth. Among other provisions, HB 917, as amended (provided by Foundation for Florida’s Future:
  • Requires the Department of Education to convene a workgroup by December 1, 2024, to identify best practices for career and technical education (CTE) in middle and high school and to establish three math pathways for high school students aligned to programs, postsecondary education and careers;
  • Allows districts to work with local workforce development boards, advisory groups and business groups to offer low-barrier alternatives to career fairs through other career and industry networking opportunities during the school day;
  • Directs the REACH Office to consult with the Department of Education and the Department of Commerce to develop a report that examines the state of career and technical education offered by local districts and to determine the alignment of program offerings and outcomes to industry demand and the state’s overall economic needs.

SB 1026 – Early Learning

Revising requirements for prekindergarten instructors; prohibiting private prekindergarten provider and public school curricula from using a coordinated screening and progress monitoring program or other specified methods for direct student instruction; revising the percentage of funds an early learning coalition may retain and expend; providing that certain Voluntary Prekindergarten Education Program students are eligible to receive instructional support in early literacy skills through a specified program, etc.

SB 1264 – History of Communism  

Governor DeSantis signed SB 1264 on April 17, 2024.  The bill does the following:

  • It adds to existing Communist history standards with instructions on the history of Communism in the United States and the tactics of Communist movements.
  • This bill authorizes the newly established Institute for Freedom in the Americasollege to promote the importance of economic anddoms as a means to advance human progress  at Miami Dade C individual, specifically in Latin America and the Caribbean.
    • This institute will partner with the Adam Smith Center for Economic Freedom at Florida International University.
  • Enables the Florida Department of State, in collaboration with the Florida Department of Education, to recommend to the Legislature the creation of a Florida-based museum on the history of Communism.
  • Prepares students to withstand indoctrination on Communism at colleges and universities.

Under the bill, the Florida Department of Education would be ordered to “prepare and offer” standards for teaching the history of communism. Certain concepts would be included that heavily emphasize the economic upheaval and personal freedom restrictions seen in many Communist nations.

SB 1270 – Sexual Misconduct Information in Public K-20 Education

Requiring district school boards to provide certain information relating to Title IX and sexual misconduct complaints to parents, students, and school employees; requiring Florida College System institutions and state universities to create a sexual harassment, sexual assault, dating violence, and stalking policy; providing requirements for such policy; requiring Florida College System institutions and state universities to create and implement a comprehensive prevention and outreach program on sexual harassment, sexual assault, dating violence, and stalking, etc.

HB 1285

The bill passed the House and Senate with updated language that caps book challenges at one per month for anyone who doesn’t have students enrolled in the school district in which they placed an objection. In part, HB 1285 does the following:

  • Provides a clear and concise process for a struggling school to convert to a charter school.
    • If a school receives consecutive low performance evaluations, it is deemed a “turnaround school.” If the district’s plan to turn the school around does not succeed, the pathway for the school to find new direction and leadership should be simple and efficient
    • These changes will eliminate lengthy and drawn-out negotiations between the incoming charter school and the school district, to ensure no student is trapped at a failing school in Florida
    • A charter school must give preference to kids in the previous school zone and must serve the same grade levels as the previous school.
    • The charter school cannot be charged rent for the facility and the school district cannot charge an administrative fee.
  • Ensures that book challenges are limited for individuals who do not have children with access to the school district’s material.
    • Unlimited objections remain for parents with children in the school district, which includes homeschooled students accessing district materials.
    • Individuals without children in the district will be limited to one objection per month.
    • Protects schools from activists trying to politicize and disrupt a district’s book review process.
  • Continues to support military families with the Purple Star Schools of Distinction Program.
    • Institutes Purple Star School Districts, which recognizes districts with Purple Star Schools making up 75% of schools in their district.
    • Helps to ensure a seamless transition for military families moving into Florida by requiring schools to provide them with support and resources.

SB 1288 – Early Child Care Universal Voucher Program

HB 1361

Education Bill by Rep. John Temple and Sen. Clay Yarborough

Ordered engrossed.  House Bill 1361 highlights:

  • Expands access to the New Worlds Scholarship to include students enrolled in a Voluntary Prekindergarten Program who exhibit substantial deficiencies in literacy or math skills based on the student’s progress monitoring assessment results.
  • Establishes a tutoring program for kindergarten through fifth-grade students with substantial reading or math deficiencies, to be administered by the University of Florida Lastinger Center for Learning.
  • Establishes a grant program for personalized tutoring for students in grades 6 through 12 and professional learning for teachers, provided by artificial intelligence platforms, subject to appropriation.
  • Establish district grants to support students and teachers in accessing safe and effective artificial intelligence-enabled educational platforms.
  • This bill designates the University of Florida Lastinger Center for Learning as the administrator of the New Worlds Reading Initiative and the New Worlds Tutoring Program and codifies new duties for the Center, including developing programs to improve student outcomes in early learning, literacy, and math.

 

HB 1362 – Education. Companion bill: SB 7038

  • Expands access to the New Worlds Scholarship to include students enrolled in a Voluntary Prekindergarten Program who exhibit substantial deficiencies in literacy or math skills, based on the student’s progress monitoring assessment results.
  • Designates the University of Florida Lastinger Center for Learning as the administrator of the New Worlds Reading Initiative and codifies new duties for the Center, including developing programs to improve student outcomes in early learning, literacy and math.
  • Establishes a tutoring program to be administered by a scholarship funding organization for students in kindergarten through fifth grade who have a substantial deficiency in reading or math.
  • Establishes a grant program for personalized tutoring for students in grades 6 through 12 and professional learning for teachers, provided by artificial intelligence platforms.

HB 1403 – Revises contributions & provisions for Florida Tax Credit Scholarship Program; revises provisions for Family Empowerment Scholarship Program, Hope Scholarship Program, virtual instruction program providers, private school requirements, & students in personalized education programs. Update 03/07/2024 -Ordered engrossed.

Bill’s key points (provided by Foundation for Florida’s Future):

  • Merges the Hope Scholarship program, which supports families in finding a safe academic environment, and the Florida Tax Credit Scholarship program;
  • Extends the Family Empowerment Scholarship for Students with Unique Abilities to up to 21,000 additional families—serving 71,000 families in total—by increasing the scholarship’s annual funding cap growth from 3% to 5%, with the opportunity to unlock an additional 1% growth each year;
  • Expands the allowable use of funds for Unique Abilities students to participate in a pre-kindergarten program offered by an eligible private school;
  • Requires the Center for Students with Unique Abilities at the University of Central Florida to establish a purchasing guideline for recipients of the Family Empowerment Scholarship for Students with Unique Abilities;
  • Prescribes specified application windows and timelines for families to accept or decline scholarships;
  • Specifies timelines for Scholarship Funding Organizations to release payments for full-time private school to within seven business days of parent and school approval;
  • Ensures public school students receiving a New Worlds Reading Scholarship can access existing transportation scholarships; and
  • Creates a new pathway under the Personalized Education Program for students seeking to use a scholarship under the Family Empowerment Scholarship for Students with Unique Abilities program, specifying that regular and direct contact can be satisfied by having in-person contact with teachers at a private school at least two days per week.

HB 1473 – School Safety

The bill modifies provisions related to the Chris Hixon, Coach Aaron Feis, and Coach Scott Beigel Guardian Program, which:

  • Clarify that private schools seeking to participate in the guardian program are responsible for costs associated with background screening in addition to costs associated with training, but authorizes the sheriff providing the training to waive the costs.
  • Provide that an individual certified and in good standing with the Criminal Justice Standards and Training Commission is exempt from the required school guardian training.
  • Change the 12-hour diversity training to training on de-escalating incidents.
  • Implement new reporting requirements related to individuals certified as school guardians and serving as school guardians in school districts, charter schools, and private schools, with penalties for noncompliance.
  • Require the Florida Department of Law Enforcement (FDLE) to serve as the central repository of information regarding certified and appointed guardians.

The bill establishes new perimeter and door safety requirements with which school districts and charter school governing boards must comply by August 1, 2024. These include:

  • Keeping routes of ingress and egress securely closed and locked when students are on campus, or actively staffed when open or unlocked.
  • Requiring that violations of such perimeter and safety requirements be reported to the applicable school official or governing board.
  • Requiring classrooms to be locked, or actively staffed, during class time, and for classrooms to have the safest part of the room marked.
  • Requiring each school district to develop a progressive discipline policy for instructional and administrative personnel who knowingly violate school safety requirements.

The bill requires the Office of Safe Schools (OSS) to, by August 1, 2024, develop and adopt a Florida school safety compliance inspection report to document compliance with Florida school safety requirements. The OSS must also:

  • Triennially conduct unannounced inspections of all public schools using the safety compliance inspection report, with associated reporting and acknowledgement requirements. The bill provides for a bonus program for school principals and charter school administrators whose schools are found to be in full compliance with school safety requirements.
  • By December 1, 2024, evaluate the distribution methodology for the Safe Schools Allocation and, if necessary, make recommendations for an alternate methodology to distribute the remaining balance of the Safe Schools Allocation.

The bill provides for criminal penalties against a person who knowingly or willfully operates a drone over a Pre-K -12 public or private school or allows a drone to make contact with a school, with specified exceptions.

The bill requires public schools, including charter schools, within the first five days of school to provide age and developmentally appropriate instruction on the use or misuse of FortifyFL, the state mobile suspicious activity reporting tool.

Lastly, the bill creates, subject to appropriation, a grant program to be administered by the FDLE to support private schools’ school safety efforts.

SB 7002 – Deregulation of Public Schools/School District Finance and Budgets, Facilities, and Administration and Oversight 

Update March 7, 2024: Ordered engrossed

A bill that looks quite different from its initial form passed the House and Senate and was sent to the Governor’s office. Many of the items in the final include the elimination of some reporting and advertising requirements for school districts, and added flexibility in setting salaries for instructional personnel.

Provisions in SB 7002 include:

  • Allowing for the use of secondary degrees in salary adjustments.
  • Provides fee waivers for teachers seeking secondary certification for Exceptional Student Education.
  • Expands eligibility for teacher apprenticeship program.
  • Removes school board requirements for financial reporting and notices.

SB 7032 – Education – Postsecondary

The bill aims to re-engage students who have withdrawn from high school by providing opportunities to earn career education credentials while also completing a standard high school diploma or equivalent credential.

Establishing the Graduation Alternative to Traditional Education (GATE) Program within the Department of Education; revising the services to which the one-stop delivery system is intended to provide access; requiring a student’s certified school counselor or other school personnel to inform the student of opportunities in the GATE Program; requiring district school boards to notify all candidates for the high school equivalency diploma of adult secondary and postsecondary education options, including specified eligibility requirements; creating the GATE Scholarship Program; requiring the department to administer the program, etc.
